Below are definitions of types of liens that we are able to register via Alberta Government Services:

  • Writ of Enforcements
    Document filed with the Clerk of the Court of Queen’s Bench. Registered with the Personal Property Registry to enforce a creditor’s interest.
  • Garageman’s Lien
    A garageman registers a lien against an owner’s vehicle for repairs, parts or storage for which he has not been paid.
  • Security Agreement
    A security interest under the Personal Property Security Act, including leases for a term of more than one year, transfers of accounts or chattel paper and consignments.
  • Sale of Goods and Factor Act Registrations
    A buyer’s interest in goods left in the possession of the seller.
  • Matrimonial Property Order or Financial Statement
    An interest of a spouse given exclusive possession by a Court of a mobile home or household goods under the Matrimonial Property Act.
  • Crown Charge
    A lien, charge or other interest of the Crown created by any law in force in Canada.
  • Land Charge
    An interest in real property of a corporation that secures payment or performance of an obligation under section 59.2 of the Law of Property Act.
  • Maintenance Order
    An order or interim order of a court in Alberta , maintenance means maintenance, support or alimony.
  • Railway Rolling Stock
    A mortgage deed under section 63 of the Railway Act.
  • Court Orders
    Any order authorized by a court or statute
  • Attachment Orders
    An order granted by the court prior to judgement, to attach to property in order to protect an interest
  • Receiver’s Report
    A notice of a financial statement or final account of the receiver’s administration
  • Statutory Charge
    A lien, charge, or other interest that affects property and is created under an enactment in Force in Alberta.

How to put a lien on property in Alberta?

How to register a lien in Alberta:

Most interests can be registered by completing a Financing Statement and submitting it to one of our agents here at GoldKey Registries for entry into the Personal Property Information System (PERPIS). Some interests may only be registered by specific representatives, as they are for specific purposes. Our friendly staff can provide more information about these interests.

Some interests must be registered within a specific time frame to satisfy time limitations within the Personal Property Security Act and other legislations. You should allow adequate time for processing by our staff if you believe there are any legislative time limits for registration. If you are unsure if your interest has a time limitation, you may wish to consult legal counsel before completing your Financing Statement.

How To File A Lien In Alberta?

How registrations are handled:

After you submit a Financing Statement to our staff, we will carefully review it. If the information is complete, accurate, and acceptable for entry, it will be submitted by our staff, into the Personal Property Information System (PERPIS), at which time a registration number will be generated by the system.

It is your responsibility to make sure that the information on any form is accurate. A registration can be invalidated or its effect impaired by an informational error or omission that is considered seriously misleading. Seriously misleading information could result in the registration not being disclosed in a search result. Particular care should be taken in completing the description of debtor names and serial numbers, when completing your Financing Statement.

A secured party has an obligation to ensure there are sufficient grounds for the registration and that the registration is made in good faith. A failure to comply with this obligation could lead to a claim by any person suffering damages as a result of such a registration. If such an unsubstantiated claim is made, GoldKey Registries may not be held liable.

After your interest is registered on PERPIS, our staff will provide you with a Verification Statement confirming the registration information as it was entered into PERPIS. Check your statement carefully to ensure that all information was recorded accurately. If errors are detected, have the error amended immediately on PERPIS. The verification statement can be used to renew or discharge your registration.
